Obtaining an EB-5 Green Card
The EB5 Visa Category provides a golden opportunity for non-US citizens who have an amount of capital available for investment, to live and work in the U.S. The issue of a Green Card, allows for legal conditional or permanent residency in America. Under the EB5 program, your spouse, and any unmarried dependents under the age of 21 are also entitled to legal status in the U.S.
Once your initial investment has been made, an immigration attorney assists with the next step: filing the EB-5 petition on Form I-526 with supporting documents. The adjudication process of I-526 may take about 3 months, although some cases may take longer.
After I-526 is approved, depending on whether you are in the U.S. or abroad, you may either "adjust the status" (if in the U.S.) or pursue an immigrant visa at your American Consulate. In most cases, adjustment of status process (I-485) is faster than consular processing.
After admission to the U.S. as a conditional resident, 21 to 24 months later a second petition (I-829) is filed with which proof of the job creation is submitted. Then full permanent residence is granted.
